About Bye-Elections

Bye-Elections, also known as bypolls or special elections, are held to fill seats that become vacant between general elections. They are conducted when a member of the legislature dies, resigns, disqualified, or expelled.

As per Section 151A of the Representation of the People Act, 1951, the Election Commission must conduct bye-elections within six months if a seat in Parliament or State Legislatures becomes vacant. This rule applies only if the member’s remaining term is one year or longer. If the remaining term is less than one year, bye-elections are not mandatory.
